…so this week, my article for TheCourt.ca is about Boumediene v. Bush instead.

    Persuasive or no, it might be difficult for y’all to find many places to apply the decision, due to your quaint lack of black sites, extraterritorial rendition, etc.

    As an Oregonian with family in and a deep fondness for Canada, I have to ask: would Canadians have found it persuasive if SCOTUS had ruled the other way? They came gawd-awfully close to doing so.
